New Vilma lawsuit asks for quick appeal ruling

NEW ORLEANS (AP) ? Saints linebacker Jonathan Vilma is suing the NFL in federal court, claiming Commissioner Roger Goodell failed to make a timely appeal ruling regarding Vilma's season-long suspension in connection with the league's bounty investigation.

The lawsuit filed Saturday night in U.S. District Court in New Orleans also asks for a temporary restraining order to allow Vilma to continue working if Goodell upholds the suspension.

The suit contends Goodell has undermined "the integrity of the NFL and the Commissioner's office" by handing down punishments to Vilma and others based on evidence that is either flawed or cannot be substantiated.

It is the second lawsuit Vilma has filed in the matter. The first, filed in May and also in federal court in New Orleans, seeks unspecified damages from Goodell for defamation of character.

In his latest filing, Vilma claims that the NFL's collective bargaining agreement required Goodell to rule as soon as was practical following a June 18 appeal hearing. Because players, in protest, declined to present new evidence or argue their case in the hearing, Goodell should have been able to rule by June 25, the first business day after the record was closed in the matter, the lawsuit argues.

It was not clear if the NFL had seen the suit. Messages left with two league spokesmen Saturday night were not immediately returned.

In his latest attack of the NFL's handling of the bounty probe, Vilma contends punished players have only been able to see less than 1 percent of the 18,000 documents the league said it has compiled. His suit also claims that the few key pieces of evidence the league shared are flawed, including printed reproductions of handwritten notes.

"The NFL's alteration of other documents evidences that the NFL cannot substantiate the suspension, and undermines the integrity of the process," Vilma's lawsuit states.

The lawsuit seeks to discredit a key piece of evidence outlining bounty pledges from before the NFC championship game against Minnesota in January 2010, and also takes aim at fired assistant coach Mike Cerullo, who, according to Vilma, produced the document for the league.

Cerullo had a vendetta against the Saints after his firing following the 2009 season, and resented that the Super Bowl ring he received had been made with imitation (cubic zirconia) diamonds, the lawsuit contends.

The lawsuit claims Cerullo created the document "well after the 2009 NFC Championship game and in an effort to gain revenge against the Saints."

The suit further contends that a "close associate" of Cerullo has confirmed that Cerullo retracted his previous claims about the bounty program "in a communication directly with Goodell that occurred in April 2012."

The lawsuit notes that Goodell has not shared notes from interviews with Cerullo. Goodell also did not produce Cerullo as a witness at the appeal hearing or acknowledge Cerullo's retraction.

However, NFL spokesman Greg Aiello has denied that key witnesses in the bounty probe have retracted statements.

Aiello also has said the NFL has not issued any gag orders. Vilma's latest lawsuit, however, claims the NFL has ordered suspended former Saints defensive coordinator Greg Williams not to speak with suspended Saints players, coaches or officials as a condition for his reinstatement.

The NFL has said that Williams, who is suspended indefinitely, organized a bounty system that offered cash for hits that injured opponents, and which ran during his three seasons as defensive coordinator in New Orleans from 2009-11.

A close friend and associate of Williams, who was present for at least one discussion Williams had with Goodell, contends Williams never acknowledged the existence of a bounty program, Vilma's lawsuit said.

Williams' associate also contends that Williams has no information corroborating NFL findings that Vilma offered a $10,000 bounty for knocking quarterbacks Kurt Warner or Brett Favre out of 2009-10 playoff games.

The same associate confirmed that Goodell ordered Williams not to speak about the bounty matter with other punished individuals, the lawsuit said.

17 Democrats join GOP in Holder rebuke

WASHINGTON -- When the House voted Thursday to hold Attorney General Eric Holder in contempt of Congress, more than 100 Democrats walked out, denouncing the vote as a political sham.

But they left behind a group of 17 Democrats who face some of the toughest re-election contests in the nation, and that group joined Republicans in rebuking Mr. Holder.

That solid block of Democratic support for the contempt motion against an attorney general appointed by a Democratic president was a testament to the GOP's ability in making Mr. Holder radioactive in some key swing districts and to the enduring political influence of the National Rifle Association in Washington.

Despite the vote, the Justice Department on Friday told House Speaker John Boehner, R-Ohio, that Mr. Holder's decision to withhold some information from an ongoing congressional probe into Operation Fast and Furious didn't constitute a crime and would not be prosecuted.

Republicans expect the vote to energize some of their most loyal supporters. But for the Democrats who voted with them, it was a chance to demonstrate independence from the party leadership and to keep NRA attack ads at bay.

"They can use this as a stark reminder that they did not follow their party leader out the door," said analyst Stuart Rothenberg of the nonpartisan Rothenberg Political Report. "These Democrats are trying to carve out records to let them prove their independence."

The NRA announced last week that they would include the lawmakers on their closely watched legislative score card. This week, the group turned over its website home page to a graphic calling for NRA members to pressure lawmakers to vote in favor of the contempt charge.

"In my district, I hear a lot about Fast and Furious. It's in the public discourse," said Pennsylvania's Rep. Jason Altmire, D-McCandless, who represents a conservative Western Pennsylvania district and supported contempt. His own vote, he said, was motivated by a desire to see Mr. Holder release documents requested by Congress. But he said the NRA has successfully raised the visibility of the gun-running operation.

Republicans pursued contempt charges against Mr. Holder after the Obama administration withheld documents demanded by lawmakers as part of an investigation into Fast and Furious, a flawed federal gun operation run by the Bureau of Alcohol, Tobacco, Firearms and Explosives, or ATF, from 2009 to 2011.

Several Democrats who backed the resolution said they voted with Republicans because they believed that Mr. Holder was thumbing his nose at the House's oversight responsibility.

"I feel Congress has a constitutional responsibility to exercise effective oversight, regardless of which administration," said Rep. Nick Rahall, D-W.Va., who stood quietly in a dark House floor corner Thursday as most of his Democratic colleagues walked out. "If there is nothing incriminating in those documents, I see no reason why they should not have been turned over."

Of the 17 Democrats voting for the contempt charge, all but one had previously received NRA endorsement, highly coveted by Democrats running in conservative districts.

NRA spokesman Andrew Arulanandam said it is too early to say whether lawmakers who opposed contempt might lose the group's endorsement. But he added: "We said we would support this vote and [that] this vote counted. We meant it, and it will."

Florida judge weighs whether to set George Zimmerman free on bail

SANFORD, Fla. (AP) ? A bond hearing took more a tone of a trial Friday when both sides in the Trayvon Martin murder case presented what sounded like opening statements with the defense quizzing witnesses and trying to poke holes in the prosecution?s evidence.

Former neighborhood watch volunteer George Zimmerman, 28, has pleaded not guilty to a second-degree murder charge in the shooting death of the unarmed 17-year-old in February. He is in jail after a judge revoked his $150,000 bond because he ruled Zimmerman and his wife lied about their finances.

He?s asking the same judge to again let him out on bail, and during a second lengthy hearing, Zimmerman?s lawyer sparred with prosecutors over those finances and questioned why his client is in jail at all, arguing that Martin?s actions led to his death. It concluded with the judge saying he would need more time to decide whether to grant Zimmerman bail again.

It was the latest in what will certainly be a string of mini-trials going forward as Zimmerman?s attorneys try to rehabilitate his credibility. In a case where he?s claiming protection under Florida?s ?stand your ground? self-defense law, his believability will be at the heart of the case. Defense attorney Mark O?Mara ultimately decided against calling his client to the stand Friday, unlike the first bond hearing in which Zimmerman apologized to Martin?s family.

He did call Zimmerman?s father to testify, and played a chilling 911 call from the Feb. 26 night when Martin was killed. A call that includes a disputed cry for help and the fatal gunshot. Robert Zimmerman said he was sure that was his son?s cry. ?This prosecutor has made a very specific showing that this case is strong,? O?Mara said. ?It was important for us to counter that.?

Circuit Judge Kenneth Lester trudged through it all, and now has to go over eight to 10 hours of evidence submitted by the defense.

Randy McClean, a defense attorney based in the Orlando area, said though he thinks there was definite gamesmanship going on, there was purpose in using Friday as ?a litmus test for the court of public opinion.?

?I think it?s less testing the judge. The judge is going to rule on issues of law,? McClean said. ?I think this is a case where Mark doesn?t have a lot to lose by putting forth this testimony. He is promoting his defense in the public. ... The jury pool is going to come from the public. I think it could be effective.?

Whatever the defense?s strategy, Martin family attorney Benjamin Crump said they hope the judge will see past it as the case progresses. ?I do think O?Mara was trying to try the case, and the judge was like ?This is a bond hearing,?? Crump said. ?I think that he understands that Zimmerman?s credibility has taken a severe hit and that at the end of the day, America isn?t going to forget that he lied to the court.?

Much of the second hearing focused on the donations raised through a PayPal account and how it was repeatedly transferred between bank accounts Zimmerman and his wife controlled. ?It was done to hide the money so they could deceive the court, lie to the court. Mrs. Zimmerman lied to the court and this defendant just sat there and let it happen,? prosecutor Bernie de la Rionda said.

O?Mara countered that ?it is not the grand conspiracy the state seems to suggest.?

There was also a great deal of evidence and testimony about the head injuries Zimmerman suffered the night of the fight with Martin, including a broken nose and cuts on his skull. Zimmerman was also described by a probation officer as a ?model client? who had not violated any of his previous bond conditions.

Shellie Zimmerman has since been charged with perjury. She is out of jail on $1,000 bond and her arraignment is set for July 31.
